18-Wheeler Accident
Our client, operating a commercial 18-wheeler, encountered an extremely hazardous situation while traveling on the interstate at night. Another vehicle had flipped and come to rest upside down in the middle of the roadway, with no headlights, taillights, or hazard signals activated. Visibility was limited, and the upside-down vehicle created a deadly obstruction. Despite this, our client was sued after striking the unlit, overturned car.
We successfully resolved the case with a settlement of $141,678.63 in favor of our client, which fully accounted for our client’s spinal injuries, wage loss, and property damage. The outcome reflected the exceptional risk posed by the other party’s conduct and effectively minimized any shared liability for our client under a high-stakes scenario.
Rather than accept fault based on a superficial impact analysis, we reframed the collision as a result of the other party’s gross negligence and failure to warn of a roadway hazard. We used nighttime visibility analysis, dashcam reconstruction, and expert testimony on driver perception- reaction times to show the crash was unavoidable. By shifting the narrative from “truck hit car” to “truck struck a completely hidden hazard,” we protected our client and secured a strong recovery under intense scrutiny.
